Advertisers Terms and Conditions
These terms and conditions establish the guidelines and obligations for advertising on Central Coast Radio.com, a service operated by Coast Radio Australia Pty Ltd. By placing an advertisement, the advertiser agrees to adhere to these terms and conditions:
Approval and Rejection: Coast Radio Australia Pty Ltd reserves the right to either approve or reject any submitted advertisement for transmission. Coast Radio Australia Pty Ltd retains the authority to withdraw or terminate an advertisement at any point, without the need for explanation. (Excluding any completed production already executed) In case an advertisement is not published, the advertiser will be reimbursed for any funds paid.
Liability: Coast Radio Australia Pty Ltd absolves itself of all liability as allowed by law, which includes consequential losses, irrespective of whether they arise from negligence or other factors.
Advertisement Characteristics: The designations "advertisement" or "sponsorship" might be utilized to distinguish advertising material that closely resembles editorial content, as decided by Coast Radio Australia Pty Ltd. The advertiser assures that the advertisement comprises precise and truthful information, devoid of any intent to mislead or deceive and in line with pertinent legal statutes. The advertiser guarantees the legality of the advertisement and its compliance with all applicable laws and regulations.
Errors: Coast Radio Australia Pty Ltd and its agents are not held accountable for errors made while taking instructions via telephone, unless written confirmation or substitute copy is received prior to the copy deadline. The responsibility falls on the advertiser or agent to promptly inform Coast Radio Australia Pty Ltd of any errors. If not notified, Coast Radio Australia Pty Ltd cannot be held responsible for the oversight.
Indemnification: Both parties agree to indemnify and hold each other harmless from any liabilities or damages stemming from the execution of this radio advertising agreement. Advertisers and advertising/media agencies pledge to indemnify Coast Radio Australia Pty Ltd, its directors, employees, contractors, and agents against all claims and liabilities stemming from the dissemination of the material. This indemnity encompasses but is not restricted to accusations of defamation, copyright or trademark infringement, unfair competition, breaches of trade practices and fair-trading legislation, violation of privacy rights, and violations of intellectual property rights. The advertiser affirms that the material adheres to all applicable laws and regulations.
Intellectual Property: Station agrees that the content of Client's ads shall remain Client's intellectual property and agrees to make no claims otherwise. Client agrees to allow Station to use Client's brands, slogans, and trademarks for promotional purposes pursuant to the terms of this radio advertising agreement.
Agreement Term: This agreement will commence as of the Client's signature date and broadcast will start on completion of ad set-up and signed client authorization of advertisement, and will continue so long as Client wishes to continue sponsorship on CentralCoastRadio.com platform. Ads go to air on signing of this agreement and only after campaign payment has been received and cleared. In the event that an ad has been produced without payment received production costs are payable and invoiced.
Cancellation: Client may cancel this agreement at any time by providing written 7-day notice via email or certified mail to the Station within 14 days prior to any production and airtime.
Amendments: This agreement may not be modified save for a joint amendment approved in writing by both the Client and Station.
Governance & Dispute Resolution: The terms of this agreement shall be governed according to the laws of NSW. Any disputes or legal proceedings shall be filed and resolved through an ADR process agreed to by both parties and/or a neutral mediator located in NSW.
